이 계약은 내려받아 기기에서 실행하는 도칼OS 소프트웨어에만 적용됩니다. 도칼게임 웹 서비스 전반의 이용 조건은 이용약관, 개인정보 처리는 개인정보처리방침을 따릅니다. 내용이 충돌하는 경우 소프트웨어에 관하여는 이 계약이 우선합니다. · This agreement covers the DokalOS software only.

중요 — 내려받기·설치 전에 읽어 주세요. 이 계약에 동의하기 전에는 소프트웨어를 내려받거나 설치·복사·실행하지 마십시오. 소프트웨어를 설치·복사·실행하는 것은 이 계약의 내용에 법적으로 구속되는 데 동의하는 것입니다. 동의하지 않으면 설치·실행하지 말고 내려받은 파일을 삭제하십시오.

이 소프트웨어 사용권 계약(이하 “이 계약”)은 히읗히읗(이하 “운영자”)이 도칼게임(Dokal Game) 이름으로 제공하는 도칼OS 소프트웨어의 사용에 관하여 운영자와 이용자 사이에 체결됩니다.

1. 정의

  1. “도칼OS 소프트웨어”(이하 “소프트웨어”)란 운영자가 도칼OS 이름으로 제공하는 다음 프로그램과 그 실행 파일·설치 파일·스크립트·라이브 이미지·부속 문서·업데이트를 말합니다.
    • 도칼부스트 for Windows(배치판 및 네이티브 설치판)
    • 도칼부스트 for macOS
    • 도칼OS 라이브 이미지(리눅스 기반 배포판)와 그 안의 도칼 도구
    • 도칼게임 웹사이트에서 제공하는 시스템 진단 기능
  2. “기기”란 이용자가 소유하거나 관리하는 PC, 노트북, 태블릿, 휴대폰 등 소프트웨어를 실행하는 정보처리장치를 말합니다.
  3. “사용”이란 소프트웨어를 기기에 저장·설치·복사·실행하거나 화면에 표시하는 모든 행위를 말합니다.
  4. “무료 베타”란 운영자가 대가 없이 제공하는 시험판을 말합니다. 이 계약의 시행일 현재 소프트웨어는 전부 무료 베타입니다.
  5. “이용권”이란 운영자가 앞으로 유상으로 제공할 수 있는 사용 권한을 말합니다.
  6. “공식 배포처”란 운영자가 소프트웨어를 배포하는 idotori.kr 및 운영자가 그 사이트에 명시한 경로를 말합니다.
  7. “오픈소스 구성요소”란 소프트웨어에 포함되거나 소프트웨어와 함께 제공되는 제3자 오픈소스 소프트웨어를 말합니다.

2. 사용권의 허락

  1. 이용자가 이 계약을 지키는 동안, 운영자는 이용자에게 개인적·비상업적 목적으로 소프트웨어를 사용할 수 있는 비독점적·양도 불가·재라이선스 불가·철회 가능한 사용권을 부여합니다.
  2. 이용자는 이용자가 소유하거나 관리하는 기기에 소프트웨어를 설치·실행할 수 있습니다. 개인 사용에 필요한 범위에서 기기 수는 제한하지 않습니다.
  3. 이용자는 저작권 표시를 그대로 유지하는 조건으로 백업 목적의 사본 1부를 만들 수 있습니다.
  4. 사업자·기관·단체의 업무용 사용, 다수 기기에 대한 일괄 배포, 사내 배포, 유상 서비스에 포함해 제공하는 행위는 이 사용권에 포함되지 않으며 운영자와 별도 계약이 필요합니다. 문의는 아래 문의처로 해 주십시오.
  5. 이 계약은 소프트웨어의 사용을 허락하는 것일 뿐이며, 소프트웨어를 판매하거나 그 권리를 양도하는 것이 아닙니다.

3. 제한 사항

이용자는 다음 행위를 해서는 안 됩니다.

  1. 소프트웨어의 수정, 개작, 번역, 2차적 저작물 작성
  2. 역컴파일, 역어셈블, 역설계. 다만 저작권법 등 법령이 명시적으로 허용하는 범위와 오픈소스 구성요소의 라이선스가 허용하는 범위는 예외로 합니다.
  3. 재배포, 판매, 대여, 임대, 재라이선스, 유상 서비스에 포함해 제공하는 행위
  4. 저작권 표시, 상표, 라이선스 고지, 실행 화면의 공식 배포처 안내를 제거하거나 변경하는 행위
  5. 도칼게임, 도칼OS, 도칼부스트, 도토리칼국수의 이름·상표·로고를 운영자의 허락 없이 사용하거나, 운영자가 배포한 것처럼 보이게 하는 행위
  6. 무결성 검증 등 기술적 보호 조치를 우회하는 행위
  7. 이용자가 소유하거나 관리하지 않는 기기를 대상으로 소프트웨어를 사용하는 행위
  8. 관련 수출입 법령을 위반하는 반출 또는 재수출

4. 지식재산권

  1. 소프트웨어와 그 문서, 디자인, 상표에 관한 저작권 등 모든 권리는 운영자 또는 정당한 권리자에게 있습니다.
  2. 이 계약에서 명시적으로 부여하지 않은 권리는 모두 운영자에게 유보됩니다.

5. 오픈소스 구성요소

  1. 소프트웨어에는 오픈소스 구성요소가 포함될 수 있습니다. 오픈소스 구성요소에 대해서는 이 계약보다 해당 오픈소스 라이선스가 우선하며, 제3조의 제한 사항은 그 라이선스가 허용하는 범위를 제한하지 않습니다.
  2. 도칼OS 라이브 이미지는 리눅스 커널과 데비안 배포판 등 오픈소스로 구성됩니다. 이 부분은 GNU General Public License version 2 등 각 구성요소의 라이선스를 따르며, 운영자가 개작한 부분의 소스는 해당 라이선스가 요구하는 범위에서 공개·제공합니다.
  3. 오픈소스 구성요소 목록과 해당 소스 사본은 아래 문의처로 요청할 수 있습니다.

6. 업데이트

  1. 업데이트, 수정본, 새 버전에도 이 계약이 적용됩니다. 다만 별도의 계약이 함께 제공되는 경우에는 그 계약이 우선합니다.
  2. 소프트웨어는 스스로 업데이트하지 않습니다. 새 버전은 이용자가 공식 배포처에서 직접 내려받아 설치합니다.
  3. Windows 설치판을 설치할 때 기기에 Microsoft Edge WebView2 구성요소가 없으면 설치 프로그램이 이를 한 번 내려받습니다. 이는 설치 과정에 한하며, 설치를 마친 뒤 실행 중에는 네트워크에 접속하지 않습니다.
  4. 운영자는 소프트웨어의 기능을 변경하거나 제공을 중단할 수 있습니다.

7. 수집하지 않는 정보

  1. 소프트웨어는 진단 결과, 기기 정보, 설정 변경 내역을 기기 밖으로 전송하지 않습니다. 계정 생성이나 로그인도 필요하지 않습니다.
  2. 웹 시스템 진단은 이용자의 브라우저 안에서만 실행되며 결과를 서버로 보내지 않습니다.
  3. 소프트웨어를 내려받을 때 생기는 웹 서버 접속 기록의 처리는 개인정보처리방침을 따릅니다.
  4. 이 조항은 운영자가 공식 배포처에서 배포한 원본 소프트웨어에 적용되며, 변조된 사본에는 적용되지 않습니다.

8. 안전 설계

운영자는 소프트웨어를 다음 원칙에 따라 만들고 유지합니다.

  1. 관리자 권한을 요구하지 않습니다.
  2. 소프트웨어가 바꾼 설정(전원 계획, 프로세스 우선순위 등)은 소프트웨어 안에서 원래 상태로 되돌릴 수 있습니다.
  3. 레지스트리, 시스템 서비스, 방화벽, 부팅 설정, 시스템 폴더를 바꾸지 않습니다. 도칼OS 라이브 이미지는 별도의 매체로 부팅하는 제품이므로 이 항의 적용을 받지 않습니다.
  4. 이 조항은 운영자의 설계 원칙을 밝힌 것이며, 제10조의 보증 부인과 제11조의 책임 제한을 배제하지 않습니다.

9. 무료 베타와 유료 전환

  1. 시행일 현재 소프트웨어는 무료 베타이며, 운영자는 기능을 변경하거나 제공을 중단할 수 있습니다.
  2. 무료 베타는 영구적인 무상 제공을 약속하는 것이 아닙니다.
  3. 운영자가 유료 이용권을 도입하는 경우 가격, 범위, 전환 방법을 미리 안내하며, 결제와 환불은 이용약관과 환불정책을 따릅니다.

10. 보증의 부인

  1. 소프트웨어는 있는 그대로(as is) 제공됩니다. 운영자는 상품성, 특정 목적에의 적합성, 권리 비침해, 무중단·무오류 동작을 보증하지 않습니다.
  2. 성능이 개선되는 정도는 기기의 사양과 상태, 운영체제, 함께 실행되는 다른 프로그램에 따라 달라집니다. 운영자는 특정한 성능 향상 수치를 보증하지 않습니다.
  3. 운영자는 공식 배포처가 아닌 곳에서 받은 사본과 변조된 사본에 대해서는 어떠한 보증도 하지 않습니다.
  4. 이 조항은 소비자 보호 등 강행법규가 이용자에게 인정하는 권리를 제한하지 않습니다.

11. 책임의 제한

  1. 운영자는 소프트웨어의 사용으로 발생한 간접손해, 특별손해, 결과적 손해와 데이터·이익·영업 기회의 상실에 대하여 법령이 허용하는 범위에서 책임을 지지 않습니다.
  2. 무상으로 제공된 소프트웨어에 관한 운영자의 책임은 법령이 허용하는 최대한도로 제한됩니다. 유상 이용권에 관한 책임의 총액은 이용자가 해당 이용권에 대하여 실제로 지급한 금액을 넘지 않습니다.
  3. 제1항과 제2항은 운영자의 고의 또는 중대한 과실로 인한 손해, 생명·신체의 침해, 그 밖에 법령상 제한할 수 없는 책임에는 적용되지 않습니다.
  4. 이용자가 이 계약을 위반하여 제3자에게 손해를 입힌 경우 그 책임은 이용자에게 있습니다.

12. 공식 배포처와 변조 사본

  1. 소프트웨어의 공식 배포처는 idotori.kr 뿐입니다. 카페, 블로그, 메신저, 파일 공유 사이트 등 다른 경로에서 받은 파일은 변조되었을 수 있으므로 실행하지 마십시오.
  2. 배포 파일의 SHA-256 검증값은 공식 배포처에 공개됩니다. 내려받은 파일의 검증값이 공개된 값과 다르면 원본이 아닙니다.
  3. 소프트웨어를 변조하여 배포하거나 운영자의 이름·상표를 사칭하여 배포하는 행위에 대하여 운영자는 저작권법, 부정경쟁방지 및 영업비밀보호에 관한 법률 등 관련 법령에 따라 조치할 수 있습니다.
  4. 운영자는 변조된 사본이나 사칭 배포물로 발생한 손해에 대하여 책임을 지지 않습니다.

13. 계약의 해지

  1. 이용자는 소프트웨어와 그 사본을 모두 삭제함으로써 언제든지 이 계약을 해지할 수 있습니다.
  2. 이용자가 제3조를 위반하면 별도의 통지 없이 사용권이 종료되며, 이용자는 즉시 소프트웨어와 그 사본을 모두 삭제해야 합니다.
  3. 해지 후에도 제4조, 제10조, 제11조, 제12조, 제14조는 계속 효력이 있습니다.

14. 준거법과 분쟁 해결

  1. 이 계약은 대한민국 법령을 따릅니다.
  2. 분쟁이 생기면 운영자와 이용자는 성실히 협의하며, 협의가 이루어지지 않으면 관련 법령이 정하는 법원에 소를 제기할 수 있습니다.
  3. 한국어본과 번역본의 내용이 다른 경우 법령이 허용하는 범위에서 한국어본을 우선합니다.

15. 계약의 변경과 그 밖의 사항

  1. 운영자는 법령을 위반하지 않는 범위에서 이 계약을 변경할 수 있으며, 변경된 계약은 이 페이지에 게시합니다. 이용자에게 불리한 중요한 변경은 시행일 전에 합리적인 기간을 두고 공지합니다.
  2. 이용자가 변경된 계약에 동의하지 않으면 소프트웨어의 사용을 중단하고 삭제할 수 있습니다.
  3. 이 계약의 일부 조항이 무효가 되더라도 나머지 조항의 효력에는 영향이 없습니다.
  4. 이 계약은 소프트웨어의 사용에 관한 운영자와 이용자 사이의 완전한 합의입니다. 다만 이용약관, 개인정보처리방침, 환불정책과 오픈소스 라이선스는 각자의 범위에서 함께 적용됩니다.

IMPORTANT — read this before downloading or installing. Do not download, install, copy, or run any part of the Software before you agree to this Agreement. Installing, copying, or running the Software means you agree to be legally bound by it. If you do not agree, do not install or run the Software, and delete any copy you have downloaded.

This Software License Agreement (this “Agreement”) is entered into between Hi-eut Hi-eut (히읗히읗, the “Operator”), which provides the DokalOS software under the Dokal Game (도칼게임) name, and you (the “User”).

1. Definitions

  1. “DokalOS Software” (the “Software”) means the following programs provided by the Operator under the DokalOS name, together with their executables, installers, scripts, live images, accompanying documentation, and updates:
    • DokalBoost for Windows (batch edition and native installer edition)
    • DokalBoost for macOS
    • The DokalOS live image (a Linux-based distribution) and the Dokal tools it contains
    • The system diagnostics feature on the Dokal Game website
  2. “Device” means a PC, laptop, tablet, phone, or other information processing device that the User owns or controls and on which the Software runs.
  3. “Use” means storing, installing, copying, running, or displaying the Software on a Device.
  4. “Free beta” means a trial edition provided by the Operator at no charge. As of the effective date of this Agreement, all of the Software is a free beta.
  5. “Pass” means a right of use that the Operator may offer for a fee in the future.
  6. “Official distribution source” means idotori.kr and the paths the Operator designates on that site.
  7. “Open source components” means third-party open source software included in or supplied with the Software.

2. Grant of license

  1. For as long as the User complies with this Agreement, the Operator grants the User a non-exclusive, non-transferable, non-sublicensable, revocable license to use the Software for personal, non-commercial purposes.
  2. The User may install and run the Software on Devices that the User owns or controls. The number of Devices is not limited within the scope of personal use.
  3. The User may make one backup copy, provided that all copyright notices are reproduced.
  4. Business use by a company, institution, or organization, mass deployment to multiple devices, internal distribution, and inclusion in a paid service are not covered by this license and require a separate agreement with the Operator. Please use the contact details below.
  5. This Agreement licenses the use of the Software only; it does not sell the Software or transfer any rights in it.

3. Restrictions

The User must not:

  1. modify, adapt, translate, or create derivative works of the Software;
  2. decompile, disassemble, or reverse engineer the Software, except to the extent expressly permitted by applicable law or by the license of an open source component;
  3. redistribute, sell, rent, lease, sublicense, or include the Software in a paid service;
  4. remove or alter any copyright notice, trademark, license notice, or the official-source notice shown when the Software runs;
  5. use the Dokal Game, DokalOS, DokalBoost, or Dotori Kalguksu names, trademarks, or logos without the Operator's permission, or present anything as if the Operator had distributed it;
  6. circumvent integrity verification or other technical protection measures;
  7. use the Software against a Device the User does not own or control; or
  8. export or re-export the Software in violation of applicable export control laws.

4. Intellectual property

  1. All rights, including copyright, in the Software and its documentation, design, and trademarks belong to the Operator or the respective rights holders.
  2. All rights not expressly granted in this Agreement are reserved by the Operator.

5. Open source components

  1. The Software may include open source components. For those components the applicable open source license prevails over this Agreement, and the restrictions in section 3 do not limit what that license permits.
  2. The DokalOS live image is built from open source software including the Linux kernel and the Debian distribution. Those parts are governed by their own licenses, such as the GNU General Public License version 2, and the Operator makes the source of its modifications available to the extent those licenses require.
  3. A list of the open source components and copies of their source can be requested at the contact details below.

6. Updates

  1. This Agreement also applies to updates, fixes, and new versions, unless a separate agreement is supplied with them, in which case that agreement prevails.
  2. The Software does not update itself. The User downloads and installs new versions from the official distribution source.
  3. When the Windows installer edition is installed, the installer downloads the Microsoft Edge WebView2 component once if it is missing from the Device. This happens during installation only; once installed, the Software does not connect to the network while running.
  4. The Operator may change the features of the Software or discontinue it.

7. Information that is not collected

  1. The Software does not transmit diagnostic results, device information, or a record of setting changes off the Device. No account and no sign-in is required.
  2. Web system diagnostics run entirely inside the User's browser and their results are not sent to any server.
  3. Web server access logs created when the Software is downloaded are handled under the Privacy Policy.
  4. This section applies to the original Software distributed by the Operator from the official distribution source; it does not apply to tampered copies.

8. Safety by design

The Operator builds and maintains the Software on the following principles.

  1. It does not request administrator privileges.
  2. Settings changed by the Software (power plan, process priority, and the like) can be restored to their previous state from within the Software.
  3. It does not change the registry, system services, the firewall, boot settings, or system folders. The DokalOS live image boots from separate media and is therefore outside the scope of this paragraph.
  4. This section states the Operator's design principles; it does not override the disclaimer in section 10 or the limitation of liability in section 11.

9. Free beta and paid editions

  1. As of the effective date the Software is a free beta, and the Operator may change its features or discontinue it.
  2. The free beta is not a promise that the Software will remain free of charge.
  3. If the Operator introduces a paid Pass, the price, scope, and transition will be announced in advance, and payment and refunds will follow the Terms of Service and the Refund Policy.

10. Disclaimer of warranties

  1. The Software is provided “as is”. The Operator disclaims any warranty of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
  2. How much performance improves depends on the Device's specifications and condition, its operating system, and other programs running alongside. The Operator does not warrant any particular performance figure.
  3. The Operator gives no warranty whatsoever for copies obtained anywhere other than the official distribution source, or for tampered copies.
  4. This section does not limit any right granted to the User by mandatory consumer protection law.

11. Limitation of liability

  1. To the extent permitted by law, the Operator is not liable for indirect, special, or consequential damages, or for loss of data, profit, or business opportunity arising from use of the Software.
  2. For Software provided free of charge, the Operator's liability is limited to the maximum extent permitted by law. For a paid Pass, total liability does not exceed the amount the User actually paid for that Pass.
  3. Paragraphs 1 and 2 do not apply to damages caused by the Operator's intent or gross negligence, to death or personal injury, or to any other liability that cannot be limited by law.
  4. If the User causes damage to a third party by breaching this Agreement, the User is responsible for it.

12. Official source and tampered copies

  1. idotori.kr is the only official distribution source for the Software. Files obtained elsewhere — forums, blogs, messengers, file sharing sites — may have been tampered with; do not run them.
  2. SHA-256 checksums for the distributed files are published at the official distribution source. If a downloaded file's checksum differs from the published value, it is not the original.
  3. The Operator may act under the Copyright Act, the Unfair Competition Prevention and Trade Secret Protection Act, and other applicable laws against anyone who distributes a tampered build or impersonates the Operator's name or trademarks.
  4. The Operator is not liable for damage caused by tampered copies or by impersonating distributions.

13. Termination

  1. The User may terminate this Agreement at any time by deleting the Software and all copies of it.
  2. If the User breaches section 3, the license terminates without notice and the User must immediately delete the Software and all copies of it.
  3. Sections 4, 10, 11, 12, and 14 survive termination.

14. Governing law and disputes

  1. This Agreement is governed by the laws of the Republic of Korea.
  2. The Operator and the User will negotiate in good faith to resolve any dispute; failing that, either party may bring an action before the court designated by applicable law.
  3. If the Korean text and a translation differ, the Korean text prevails to the extent permitted by law.

15. Changes and miscellaneous

  1. The Operator may change this Agreement within the limits of the law and will post the changed Agreement on this page. Material changes that are unfavourable to the User will be announced a reasonable time before they take effect.
  2. If the User does not agree to a changed Agreement, the User may stop using the Software and delete it.
  3. If any provision of this Agreement is held invalid, the remaining provisions stay in effect.
  4. This Agreement is the entire agreement between the Operator and the User regarding use of the Software. The Terms of Service, Privacy Policy, Refund Policy, and the open source licenses apply alongside it within their own scope.
